1.1. The Nexo Card “X3 Cashback” Promo (hereinafter referred to as “the Promo”) shall be conducted within the period from 13:00 UTC on November 21, 2023 until 23:59 UTC on December 31, 2023 (hereinafter referred to as “the Promo Period”).
1.2. The organisation and conduct of the Promo, as well as the participation therein, shall be governed by the terms and conditions of the present rules (“the Rules”), the Nexo Services General Terms and Conditions, Nexo Crypto Credit General Terms and Conditions and Nexo Card General Terms and Conditions (“General Terms”), available on the Nexo Platform.
2.1. Clients who comply with the Rules and the General Terms, haven’t initiated any Nexo Card transactions (“Transaction”) and are not (i) residents or citizens of the USA, (ii) or residents of Canada, UK, or any other jurisdictions where we have restricted our services can participate in the Promo (separately referred to as “Participant” and collectively as “Participants”).
2.2. By participating in the Promo, every Participant declares full and unconditional consent to the Rules and agrees to accept as final and binding all Nexo’s decisions with regard to the Promo.
3.1. To be eligible for a reward from the Promo, the Participant has to initiate one or more Transactions, which are eligible for cashback<sup>1</sup>, during the Promo Period, regardless of whether it's made under the credit or the debit mode of the Nexo Card.
3.2. Each Transaction is taken into consideration based on the USD value indicated in the Nexo Account.
4.1. Subject to fulfilling all requirements stated in Article 3, the Participant shall receive cashback for each Transaction, based on the Participant’s Loyalty Tier at the time of said Transaction, up to three times the standard cashback as per the limitation stated on the Nexo Platform (“the Reward”). The Reward shall be paid only for Transactions executed during the Promo Period and will be paid out in the type of Digital Asset chosen by the Participant depending on the available methods and will be distributed no later than 48 hours after each Transaction is settled.
4.2. The monthly cashback limits for the Promo Period shall be doubled and based on the Participant’s Loyalty Tier. In case the Participant’s Loyalty Tier changes during the Promo Period, the monthly cashback limit will be updated accordingly, however, pending Rewards will not be affected. Nexo reserves the right to reject any pending and future Rewards in case of any attempts to temper the operation of the Promo.
4.3. Requests for cash or another reward substitution and requests for transfer or assignment of the reward to third parties shall not be allowed nor considered by Nexo.
5.1. Nexo reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promo should virus, bug, non-authorized human intervention, fraud, or other cause beyond Nexo’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promo.
5.2. Nexo reserves the right, at its sole discretion, to disqualify, revoke or deny any Reward, block access to products, or exclude from future promotional offers any Participant who tampers or attempts to tamper with the entry process or the operation of the Promo. Nexo has the right, at its sole discretion, to maintain the integrity of the Promo and to void entries for any reason, including, but not limited to, the use of bots, macros, scripts, or other technical means for entering. Any attempt by a Participant to undermine the legitimate operation of the Promo may represent a violation of criminal and civil laws. Should such an attempt be made, Nexo reserves the right to seek damages to the fullest extent permitted by law.
6.1. Nexo, at its sole discretion, at any time during the Promo Period, can amend the Rules, whereas all amendments shall become effective as of the date of publication of the amended version of the Rules on the Nexo Platform.
6.2. Any notice required or made under these Rules by any Participant to Nexo shall only be made via e-mail in English to [email protected]. Any notice required or made under these Rules from Nexo to any Participant shall be considered validly received when addressed to the Participant’s last provided email address, mailing address or phone number.
6.3. All relations between Nexo and the participants will be governed by the Rules and the General Terms and the applicable law, as defined by the General Terms.
1As announced on the Nexo Platform, certain transactions are ineligible for Nexo Card cashback and the Promo. All other limitations and restrictions for the Nexo Card, available on the Nexo Platform, shall apply accordingly.
